its one thing for the driver to willfully (though probably ignorantly) take his or her life into their own hands, but with others in the car?

People are just not very intelligent.

And we sit back, and like the Metro-North Valhalla crash, wait for the relatives of the deceased to sue the railroad.

Exactly!  Why didn't the train swerve to avoid hitting the car sitting on the track.  Or just stop?

Latest news reports suggest that the "genius" may have been in the process of fleeing the scene of a prior accident.

That Mensa statement was I'm sure facetious.   We have here what is called a Darwin-award recipient.

I'm somewhat surprised we haven't had similar tragedies in our town. We have the classic situation of multi-track crossings with one seeing very slow, very long trains 18-20 times a day, the kind of train movements that cultivate motorist contempt for the crossing warnings. The other tracks are at 45 mph, and, of course, you don't see or otherwise process there could be a much faster train on another track. We once witnessed a barely-miss firsthand where I'm sure the four kids in the car had to change underwear on getting home.
