It's always amused me that the company that makes those things rips off the Blomberg truck so blatantly.

it's actually a model of the Southern Pacific #1, the C.P. Huntington, which lives in the California Railroad Museum

No, it's supposed to be a model of a Blomberg. It's the only off-the-shelf truck available in 15" gauge with integrated drive. It was originally made for zoo/amusement park F-units. The company who makes that faux steamer uses them as a matter of convenience for the gasoline drivetrain, the big 2-wheel driver is a dummy. This is versus the cost of designing their own archbar truck, especially given all the modern grief coming from state regulators - and even the FRA - regarding "passenger conveyances".

But I thought that recent incident at the park proved that there AREN't applicable regs. That definitely makes  sense from a reuse perspective. It's not like most kids would care.

Huh. There's obviously some state-to-state variances. In Illinois, a regional favorite park line built in the '50s went through all sorts of... uh... "heck" after a new donor and operator started restoring the deteriorated assets. Possibly the difference here was that live steam was involved, and definitely in that case you get into the new boiler regs. But I do recall the state amusement park regulator had to approve the track and rolling stock work, too.
