Here's a handy tool I made to ensure proper spacing between tracks AND from the back wall.

I like your attempts at ingenuity, but I'm not sure that I'm keen on this tool.  You're, in effect, scribing the track centerlines to the back wall, which, as you know, is not straight.  You'd do better to merely use your 48" straightedge for tangent track and then use your new tool to set the parallel track.

Definitely an air leak.  For that matter, Ed, did you install any of that air conditioner strip-type foam that you jam into the open sash to prevent drafts there, since the meeting rails no longer seal that joint where the window locks?

Ah, it's ok guys, that's an optical illusion.
That's not the window coming out of the track. It's just some of the insulation being visible.

The window is indeed sealed all around.

I’m in the process of working on the outside of my house now after completely finishing the inside.
The amount of mess ups done by the so called professionals I have found is amazing and at the same time depressing. But now fixed properly.
 Still, none as bad as that photo, assuming the construction was designed to be a window opening.
The sad conclusion I’ve come to is
The only way to get it done right is do it yourself.

It's insane. Our place is the same way. Someday you come visit your tortoise mounts I'll have to show you how the back part of the basement was handled when they added on the addition...
