From the Microscale email newsletter:

It brings me tremendous sadness that the following decals from Genesee & Wyoming (GW) has been discontinued at the request of the company.
87-1501 Genesee & Wyoming (GW) Canada Region Shortlines
87-1502 Genesee & Wyoming (GW) Extra Stripes and Numbers
87-955 Buffalo & Pittsburgh, Genesee & Wyoming, Rochester & Southern Diesels (1989+)- Diesel
87-1426 Genesee & Wyoming (GW)-Western Operators & Shortlines
87-1445 Genesee & Wyoming (GW) Mid-Western Division Shortlines and Operators
87-1472 Genesee & Wyoming (GW) - Ohio Valley Division Shortlines & Operators

Presumably IP related. Not sure why N wasn't discontinued - perhaps an oversight...

I have no dog in this hunt, but this and the PanAm thing is childish. :x

What is their objective? My IP lawyer tells me the legal principle on locking down trade dress is to "prevent brand confusion" relative to competing services or products. If G&W starts offering their own line of models, then more power to them, but to declare the image off limits in absence of that won't bear the weight of an honest legal challenge. Time for MTH to throw their weight around again.

UP, Pan Am, now this...   Soon we'll all be running undecorated!   :facepalm:

UP was resolved amicably, as were the other majors.

I have two units in the paint shop as we speak.  I contacted the guy doing them and he said he had seen the news and stocked up on what he could get.

I get the idea of requiring permission, but it seems well documented that big railroads going down this path turned around to a sane policy.

Do manufacturers just run schemes without asking railroads, with exemption to those who already have licensing agreement s ?

If money is involved, of course they will go there.  They don't have to do anything to get it, other than say "Hey, yeah it's ok to model our equipment/roadname/colors/tradmark/logo etc but we need some $$$$ to allow that."

You guys are missing the larger point:
 -  If you do not defend your trademarks and trade dress in every arena, even one as small as our hobby, your inattention can be used against you when attempting a defense that IS important to the company's operations.

Now it's true that, along the way, some idiot lawyer (a redundant term, I admit) will convince themselves that there are riches to be had in the process.

Life in the 21st Century is nasty & adversarial.

That is true.  And it's not necessarily the lawyers with the goofball ideas but they are the ones who are tasked with the job so yes, it's a lawyer who will be contacting you and trying his damnedest to fulfill his assignment, silly as it might be.   :)
